摘要
公平和效益是证券民事侵权诉讼前置程序的重要价值。两个价值具有一致性,两者互相包容。但两者冲突也是明显的,前置程序在实现效益价值的同时,使公平价值受到很大损害。两个价值的冲突引起学界的探讨。通过协调前置程序的两个价值,建议取消或改进前置程序。
Fairness and benefit are important value of prepositional procedure of litigation of securities infringement.They are in common and in conflict as well.Prepositional procedure do a great harm to fairness when it realizes the value of benefit.There are many discussions on the conflict of two values.To compromise the two values of prepositional procedure,we suggest canceling or improving prepositional procedure.
