摘要
随着城镇化的推进,大量农村土地转为城市用地具有一定必然性,在土地征收的补偿安置过程中,由于补偿是政府的行政行为,由于法律的不完善和公务员的"经济人"现象,在行使补偿安置的时候自由裁量权没有得到很好的限制,严重违反了法律的初衷,侵犯了农民的合法权益。所以,必须对补偿安置的过程做出具体的法律指导,维护农民的合法权益,减少贫富差距和社会分化。
