摘要
动产因其具有可移动性和位置的可变换性,加之占有人之过失,就会导致遗失之风险。那么当物遗失后,如何保护原权利人之权利,发挥物之价值,实现对物之有效利用,维护经济交往的正常有序进行?仅仅规定拾得人的一系列强制性义务是不够的,最行之有效的办法应是通过正确的确立拾得人的切实可行的权利和义务,以此来刺激拾得人尽快确定物之所属,以实现物尽其用。
Because of the movable character of movable property and the possessor＇s negligence, movable property mav be lost. Then, if mivable property is lost, how to prospect the owner＇s ownership, output the property＇s valuation, exploit the property＇s merit, maintain the order of economy communication？ It is not enough just fixing keepers＇obligation. The most valuable method is to establish the keepers＇ proper rights and duties, in order to confirm the belonging of the property and make full use of it.
