摘要
网络传播权随着网络传播技术的飞速发展而产生,对其进行限制的理论基础是著作权限制理论。对网络传播权限制应当遵循效率与公平的平衡统一原则、现代化原则、国际化和本土化相结合原则、诚实信用原则和公序良俗原则。对网络传播权限制的核心内容是构建其合理使用制度。
The computer-mediated communication came along with the rapid development of information technology.The theoretical basis of restricting it is the theory of restriction on copyright.The restriction on the right of CMC should follow such principles as the principle of balance and unity between quality and efficiency,the principle of modernization,the principle of combining internationalization with localization,the principle of good faith,the principle of public order and good conversation.Its key part is the construction of 'fair use' regulation.
