摘要
刑事辩护制度的产生和存在有着深刻的哲学基础。主体理念是其首要的哲学基础,而唯物主义为刑事诉讼制度继而也为刑事辩护制度奠定了坚实的基础。辩证法则是刑事辩护制度产生、运行的方法论。
The creation and existence of the system of criminal advocacy have a profound philosophical foundation. The concept of subject is its first philosophical foundation. The materialism lays a solid foundation for the system of criminal procedure and the system of criminal advocacy. The dialectics is the methodology of the creation and operation of the system of criminal advocacy.
