摘要
立法的缺陷导致司法实践中往往不能正确分析交通肇事行为人的主观心态和客观事实,不同地区适用法律的情况也不一致,影响了法律的威信,造成了比较严重的后果。为达到罪刑相适应的目的,只有通过立法,或通过修改刑法来加以解决并使之完善。
The legal defaults result in the incorrect analysis of the subjective mentality and objective reality of causing traffic casualties in the judicial practice, and the conditions differ from each other, so the prestige of the law is influenced and sometimes serious results are made. It must be solved and perfected with the measures of legislating law or modifying the criminal law so as to suit the punishment to such crimes.
