摘要
云南省是矿业大省,应通过建设矿权市场来推动矿产资源勘查的快速发展。建立云南省矿权市场的关键问题有二,一是政府角色定位问题,一是如何确定交易标底性质的问题。政府应是矿权市场的监管者、调控者、其职能是制定政策并监督政策的实施。交易标底性质的确定应首先界定哪些矿权适用于招标、拍卖、挂牌出让,并提倡土地使用权与矿权合并转让。
Yunnan is a province rich in mineral resources. It should improve the mining right market in order to promote the development of mineral resource prospecting work. Key factors of building up mining right market in province Yunnan consist in how to fix the position of government role and how to fix price floor of mining rights. Government should be supervisor and controller of the mining right market and its function is to formulate the policies and supervise policy implementation. Before the fixation of price floor of mining right transferring, government should delimit which mining rights fit to invite tenders, hold the auction or transfer on the basis of competition and advocate transferring land use right and mining rights together.
