摘要
当今世界绝大多数非法治国家均把实现现代法治国家作为其法律和社会发展的最主要目标。而法治国家的建构,离不开行政法作用的发挥。本文从现代法治国家的人权保障、权力制约、法治政府、法律体系、法治观念五个方面,提出并论证了行政法对法治国家的实现能发挥最为重要、最为关键的作用。
Nowadays most of states not ruled of law in the world choose to realize a modern state ruled of law as their most important goal that may be achieved of legal and social development. However, constructing such a state shall not be separated from the contribution of the functions of administrative law.This article puts forward and explains firstly the most momentous functions which administrative law can contribute to the realization of modern states ruled of law in the following aspects: protection of human rights, control over powers, government ruled of law, legal system and sense of rule of law.
