摘要
目前,理论界对依据宪法制定部门规章有不同的解释,其原因是缺乏对宪法原则与原理的深刻认识。因此,人们很有必要明确国务院各部委制定部门规章的宪法依据及其意义、地位。
Recently, theorists give diversified explanations for the practice of ministries and commissions to draft their own regulations in light of the Constitution. The fundamental reason for this disagreement lies in the lack of insights into the principles and theories of the Constitution. Therefore, it is imperative to deepen the understanding of the constitutional basis, significance and jurisdiction of the regulations drafted by the ministries and commissions under the State Council.
