摘要
“孤证”就是指单个的证据。由于对法律的理解不同,对孤证也出现了三种不同的认识。在刑事立案、侦查、起诉和审判各环节对证据的运用要求以及对案件的证明标准都是不一样的。正确理解和认识孤证问题有助于提高诉讼效率。这就要求司法人员转变思想观念,树立正确的诉讼意识和证据意识,提高分析和解决问题的能力,从而更好地为法治建设服务。
Single evidence is very common in practice of current criminal lawsuit. According to the different comprehension on law, there appeared three kinds of understanding. To comprehend single evidence properly is helpful to improve the efficiency of lawsuit. Therefore it requires judicial personnel change their ideological sense, and set up correct consciousness of lawsuit and of evidence to serve the construction of legal system better.
