摘要
在庞德看来,历史上各种法律哲学和法律思想存在着一个一般性的思想谱系。据此,庞德的社会学法学理论通过对19世纪历史法学派的直接批判得以转出,同时,其理论的最终建构也是对当时社会历史情境的回应和对各种外部思想资源的借鉴和吸收。庞德社会学法学理论的建构路径可能的启示在于,在建构中国当下的法学理论中或许可以寻求到一条相似的建构路径。
According to Roscoe Pound’s opinion, there is a general thinking pedigree among the legal philosophies and legal ideals in human history. In view of it, Roscoe Pound advanced his ideal of sociological jurisprudence through directly criticizing the theory of historical jurisprudence that has been prevailed in the 19th century. Meanwhile, his theory also made response to the historical and social context of the time while referring to some exterior thinking resources. The construction path of the sociological jurisprudence may provide us with some inspiration, whereby we can find a similar approach through which a new legal philosophy will be brought forward and developed.
