摘要
受托人制度系信托制度之核心,而共同受托人也是现代信托制度的必然产物。但在信托实践中共同受托人的资格、共同受托人与信托财产的关系、共同受托人处理受托事务的方式以及共同受托人的义务和责任等问题都是摆在我们面前亟待解决的问题。文章旨对以上问题做一探讨。
The system of trustee is the core of trustsystem. And joint trustee is the outcome of modern trust. However, there are many problems which need to be urgently solved in practice, such as, the qualification of joint trustee, the relationship between join trustee and trust property, the mode that joint trustee deals with trust affairs, and the obligation and liability of joint trustee. The author discusses the questions mentioned above.
