本文深入系统地论述了作为一种特殊犯罪形态的过当犯的概念界定、构成特征与类型划分;并在确立过当犯是紧急行为的过当形态基础上将过当犯分为过当防卫犯、过当避险犯、过当自救犯和紧急职务行为的过当。
This article makes a statement on the definition, constituting elements and types of the crime of over - defending. The crime is a kind of over-response to emergency due to both subjective and objective elements. Its types are classified as over- defending, over- response to avoid danger, over self- rescue, and over- reaction in professional work.
