摘要
法律语言心理学与心理语言学和法律心理学有着十分密切的联系,但是由于法律语言心理学毕竟同时涉及法学、心理学和心理语言学这三个学科的相关内客,具有更为复杂的因素,提出了更为丰富的研究任务,要求崭新的研究角度,因此是与心理语言学和法律心理学截然不同的学科,属于法律语言学领域内的分支领域。本文从几个方面来论证法律语言心理学的特殊性、研究目标、研究现状、发展前景等基本的学科特点。首先提出法律语言心理学的定义,然后对法律语言心理学与心理语言学的关系以及与法律心理学的关系做出简略的评论,以阐明法律语言心理学的学科定位,证明法律语言心理学的独特性及学科发展的必要性。本文在第二部分通过对重要研究课题的讨论,阐述法律语言心理学研究的用途。第三部分集中评述目前的研究状况,对现有研究队伍和条件做出评价,对一些典型研究课题进行个例分析,对目前的研究成果进行概括。第四部分对法律语言心理学研究的前景进行展望,讨论的内容包括理论建设、研究任务、研究的应用、研究队伍的发展等。
With the development of forensic linguistics, the research of language and psychology in the context of law has been valued by more and more researchers and it has laid solid foundations for forensic psycholinguistics as a scientific discipline. Although forensic psycholinguistics is akin to psycholinguistics and forensic psychology, because of its multiplicate relations with law, psychology and psycholinguistics and because of the complex factors it has, the copious research tasks it sets off and the new points of view it demands, it is a discipline totally different from the afore-mentioned.The present paper, from a few aspects, tries to elucidate the distinguishing characteristics, research objectives, the status quo and the prospects of the discipline of forensic psycholinguistics. First the definition is given to allude to the orientation of the discipline. Then a brief comment is presented on its interrelations with psycholinguistics and forensic psychology in order to clarify the orientation and reveal its specialness and the necessity of its development.As forensic psycholinguistics comes into being to meet the urgent need of forensic linguistic research and legal activities, the second part of the paper discusses the usefulness of the research of forensic psycholinguistics. The third part of the paper focuses on the status quo of the research with comments on the present conditions, typical research topics and the present research achievements. The fourth part gives a predictive view of the future concerning the construction of the theoretical framework, the research tasks, and the application of the researches.Pwensic psycholinguistics is now still in its embryonic stage, and the theories and methodology are far from fledged. Thus the present discussion is mainly based on the limited observance and understanding of the author.
