租约中一般有所谓“安全港口”和/或“安全泊位”条款,规定承租人指定的港口、泊位或地点,对租约中的特定船只必须是安全的,这就是承租人的安全港义务。
As to the charterer’s safe port duty, the common law has developed three different theories,“Warranty”theory,“Roskill”ap-proach and“Faulty”theory. These theories are consistant when they concern with starting, continuity and ending of the charterer’ssafe port duty, but quite different in respect of the legal nature of the duty. According to the“Warranty”theory, the charterer’s safe port duty is absolute, which balances the owner’s duty of complying with charterer’s port order. So this theory is a reasonable explanation. Both Chinese arbitration awards and the relevant stipulation of China Maritime Code agree with“Warranty”theory.
