摘要
程序具有两个层面的价值:外在性价值和内在性价值。程序正义是程序的内在性价值。程序正义的标准有:科学性、中立性、平等性、公开性。程序正义在法治实践中有着重要价值:程序正义对于保障和实现人权具有重要意义;能更好地促进法律的实施和遵守;有利于法制的进一步完善。
The procedure has value of two aspects: externalism value and inherent value. The justice of the procedure is the inherent value of the procedure . The standard of the justice of the procedure has: science , neutrality , equal , openness. The justice of the procedure has important value in practice governed by law: The justice of the procedure has the signification for ensuring and realizing human rights,promoting the implementation of the law and observe better,being favorable to the further perfection of legal system .
