摘要
口供对于证明案件事实具有独特而又重要的证据价值,但为获取口供而不惜刑讯逼供显然是错误的。本文通过透视刑讯逼供的危害,分析其现实成因,提出对我国当前司法实践中刑讯逼供现象的应对策略。
Although confession has the unique and important probative value to prove the fact of law cases, it is obvious mistake to extort confession by torture. In this article, the author analyzes the practical cause through displaying the damage of extorting confession by torture and put forward the countermeasures to the extorting confession in judicial practice.
