摘要
谋杀罪在英美刑法中既是普通法上的一种严重犯罪 ,同时也是制定法中的严重犯罪。我国虽然没有对谋杀罪的规定 ,但我国刑法中有对故意杀人罪的具体规定 :故意杀人罪是指故意非法剥夺他人生命的行为。我国的故意杀人罪和英美刑法中的谋杀罪同中有异 。
Murder is a kind of serious crime in both common laws and statutory laws of English-American criminal laws. Although murder is not prescribed in China, intentional killing cime is provided under the article 232 of criminal law. It is needed to analyze the difference and sameness between the murder in English-American and intentional killing cime in the criminal law of our country.
