摘要
由于我国目前处于社会转型期,宪法与现实的冲突不可避免,而宪法的不断修改却有可能破坏其权威性。考察了我国宪法权威的现状;指出了由于政策优位和法律优位在现实中的存在,使得我国宪法仅具有形式上的权威而不具备实质权威。
As China is now in the social transforming stage, the conflict between constitution and reality is unavoidable, but constant revise of constitution will possibly destroy its authority. Inspecting the present state of constitution authority of China, the paper points out the existence of superior policy and superior law in reality, which makes our constitution only have formal authority, but the essential authority does not exist.
