摘要
陪审制是我国一项重要的司法制度。本文介绍了我国刑事诉讼中陪审制的历史和现状以及英美法系国家刑事诉讼中陪审制的状况 ,通过比较二者的不同 ,否定了学术界提出的移植英美陪审团制度的主张并对我国的人民陪审制度提出了完善的建议。
Jury system is an important component of judical system of China.There are distince diffenrences betwwen history and status in quo of jury system of China and that of common alw contries in criminal cases.So,instead of transplanting common law contries's jury system,pefecting the exsiting people's jury of China should be adoptted to achieve the purpose of ameliorating the jury system of criminal cases.
