摘要
刑事诉讼职能是国家专门机关和诉讼参与人为实现参加诉讼的目的和承担的任务而在刑事诉讼中进行活动所应发挥的作用和功能。其经历了古代弹劾式诉讼,中世纪纠问式诉讼和现代混合式诉讼的历史演变而逐渐发展到今天。刑事诉讼职能可分为基本职能和非基本职能。其中,控诉职能,辩护职能和审判职能是现代刑事诉讼的三大基本职能。
Criminal suit function refers to the role and function that the national special organs and the people who involved in the suit, should play to accomplish their purpose and take their task. It went through the following three periods : the ancient impeachable lawsuit, the Middle Age capturing lawsuit and the modern mixed lawsuit. Criminal suit function can be devided into basic function and non- basic function, of which the accusation function, the defense function and the judicial function are the three most basic ones.
