摘要
现代社会中广泛存在着共同的国家职能,即依照宪法的规定,对于某一国家权力行为是否符合宪法进行审查,并作出法律意义上的裁断。美国的违宪审查职能是司法功能的延伸和发展,与美国重视实践的司法传统密切相关。
In modern societies there is a national function pervasively existing in all countries. That is, to review, based on the stipulations of constitution, whether a state right act is in line with the constitution and then make a judicial judgment accordingly. Judicial review function on unconstitutional acts is the extension and development of judicial function in USA, whose establishment is closely connected with American judicial tradition of emphasizing practice.
