摘要
代位申请执行是债权人保护自己权利的一项重要手段,但现行的司法解释对代位申请执行的规定比较简单,有些规定不尽合理。所以,有必要针对现行代位申请执行规定中存在的问题,在立法上加以修改和完善。
Subrogation enforcement is an important means for the creditor to protect his rights. However, the present judicial interpretation on subrogation enforcement is so simple that it is irrational in some aspects. This article points out the problems concerned to prefect subrogation enforcement in legislation.
