摘要
论证我国涉外仲裁裁决撤销制度存在的必要性,认为该制度应当以维护仲裁自治性为目的,合理规范法院的司法审查权,然后根据这一结论考察我国涉外仲裁裁决撤销制度存在的问题,并提出相关建议。
This paper firstly expounds the necessity for the existence of system of repeal of arbitration award concerning foreign interests in our country, and proves that this system shall reasonably regulate courts power of judicial review with the purpose of safeguarding autonomy of arbitration. Then according to the above conclusion, the author inspects some questions that exist in the system of repeal of arbitration award concerning foreign interests of our country, and puts forward some simple related suggestions.
