摘要
主权概念产生于国家型构的需要,随后又逐渐发展成为国际法的一项基本准则。在人类社会迈入20世纪之后,主权概念受到诸如主权消亡论之类的诸多挑战。但实践证明,主权概念在其数百年的演进历程中所积淀下来的元价值却是任何挑战都不可动摇的,即便是在全球化的背景之下,主权概念的国家型构、社会安全、人权保障、公意凝聚与国际和平等基本价值,仍然是国内政治乃至国际政治得以维系的价值基础;如果拆除国家主权这根支柱,不仅国家这座大厦将顷刻倒塌,而且国际政治也势必堕落为弱肉强食的无政府状态。为此,有必要对主权概念进行正本溯源,重申主权概念的基本价值,使国内政治与国际关系重新回缚于国家主权的价值基础和基本准则。
From its first day,the sovereignty concept has been regarded as a cornerstone of national politics and a principle of international politics.After 20^(th), the sovereignty theory has been meeting with many challenges such as this argument of sovereignty out-of-date and so on;and these challenges are eroding the base of soverreignty value.But its basic values are not to be shaken.Even if during the globalisition times,sovereignty's primary values are always the inner factors of politics of nation and internation.If we abandon the conception of sovereignty,not only state will fall apart but also the international politics will fall into the state of war which is the law of the jungle. Therefore,it is necessary to answer challenges to uphold state sovereingty to trace the sovereignty source and to investigate its primary value from the evoluting course of the sovereignty theory.
