摘要
“分权”和“制衡”原则是美国政府权力的宪法基础,也是美对外政策复杂性、困难性和不确定性的根源。美国国会正越来越多地以立法或非立法形式影响着美国的对华政策,客观上已成为对中美关系的主要干扰。美国总统出于其国内政治和国家利益的双重需要,对华政策总是具有两面性,近年来正逐步使“一个中国”原则空洞化。美国联邦法院在中美关系中的作用有所突出,值得注意。
The principles of separation of powers, check and balance are the constitutional foundation of the American govern-ment powers as well as the source of the features of American foreign policy, namely, complexity, difficulty and uncertainty. The American Congress, with the use of both legislative and non-legislative means, is exerting more and more influence on American foreign policy toward China. It has become a major interference in China-American relations. To meet the needs of both domestic politics and national interests, the American President's policy toward China has a dual character, which makes 'One China' policy gradually desubstantiate. The role of American federal courts in China-American relations has recently become somewhat conspicuous and therefore merits attention.
