摘要
中西社会宗教和文化底蕴的不同导致市民社会的差异 ,而这种差异致使中国的刑法机能与西方国家的刑法机能存在根本不同 。
The different religion and culture in eastern and western society cause the difference of citizen society.While citizen difference of society result in the difference between criminal law function of China and criminal law function of western countries:namely the former pays attention to guaranteeing function of criminal law comparatively but the latter even more attaches great importance to protecting function of criminal law.
