摘要
在财产保险中 ,受益权是被保险人享有的一种财产权 ,被保险人有权处分自己的权利 ,另行指定受益人来行使受益权。这种权利处分与保险事故发生时被保险人是否生存没有必然关系 ,并且也未使保险人和其他第三人受到损害 ,导致诱发道德风险发生的可能性增加 。
In property insurance, beneficial right is a property right owned by the assured, who is entitled to dispose of his rights and specify beneficiaries. This disposal right has no positive connection with whether the assured is alive when insurance accidents occur, and also brings no damage to the assured and third party, thus should be legally protected.
