摘要
分析了诱惑侦查正当性之成因、正当性之条件、正当性之认证及诱惑侦查与诚信原则之关系。认为诱惑侦查具有正当性 。
This article analyses the causes, conditions, and judgments of justifiability for police encouragement, and demonstrates the relationship between police encouragement and honest-trust principle as well. It holds that police encouragement is proper and should be appropriately applied.
