摘要
人民监督员的监督意见大致分为同意检方意见无建议型、同意检方意见有意见型、不同意检方意见型等3个类型。从现有的制度设置来分析,人民监督员监督意见的效力,本质上由检察院最终决定,存在先天性效力弱化倾向。这种效力式弱的现状,会导致人民监督员制度价值追求落空、检察官消极应对、人民监督员配合应付等后果。防止人民监督员制度在推广中步入形式化的困境,应做到在意见生成的路径安排上更合理,同时引入专业性专家论证与民主性人大监督两个加强程序,最后实现对人民监督员监督意见,由检察院之外的主体作出终局决定。
People’s supervisors’ views fall into three types: agreement with prosecution with no suggestions,agreement with persecution with suggestions,and disagreement with persecution with suggestions. Based on the current legal institutions,the effectiveness of people ’s supervisors ’ views or suggestions is determined by procuratorates,which unavoidably causes the discounting of people supervisors ’ views. Such discounting will further lead to the empty shell of such a supervising system,where both persecutors and people’s supervisors’ passively muddle through the supervision. To prevent such a supervision system from falling into the trap of formalities,how the effectiveness of supervisors’ views is generated should be managed rationally,with the introduction or enhancement of professional experts’ argumentation and the supervision by People’s Congress. Finally,the people supervisors’ views are finally judged by non- procuratorates’ bodies.
