摘要
确定跨行政区划检察院设置及其案件管辖,应当基于我国单一制的国家结构形式、诉讼经济原理、司法改革相关政策、行政区划改革政策等因素,以及跨行政区划检察院管理体制。必须以坚持检察职权法定为前提,弄清楚跨行政区划检察院管辖的案件从哪里来,到哪里去。由跨行政区划检察院的功能所决定,其管辖案件应当实行固定管辖与接受指定管辖相结合。其固定管辖案件需要与按行业设置的公安机关侦查职能大致衔接,与跨行政区划法院的管辖范围大致对应。其接受指定管辖的案件应当是具有受地方因素影响的高度可能性的案件或者已经受到地方因素影响的案件。
The establishment of cross- administrative- division procuratorates and cases jurisdiction should be defined based on the following factors: the unified government system of China,economy notion in lawsuit,related policies of judicial reform,policies of administrative division reform,and the management system of cross- administrative- division procuratorates. The cases jurisdiction should be clarified under the premise of legal procuratorial power. Determined by the function of cross- administrative- division procuratorates,the jurisdiction should consist of fixed jurisdiction and appointed jurisdiction. The fixed jurisdiction should approximately connect with the detection function of sector- based public security organs,and correspond with the jurisdiction of cross- administrative- division courts. The appointed jurisdiction should consist of the cases that may or already influenced by local factors.
