摘要
在行政法学视野下,我国公租房制度体现为一系列贯穿权力逻辑的公共政策实施脉络。以此为参照系,通过认知客观环境、明确价值取向、选择具体供给模式的行动体系分析,可以发现,基于普遍福利的公租房供给区别于特殊福利的行政给付,创造城市发展的流动居住空间以满足公民的发展需求才是其真正致力于实现的,因此公租房制度要避免在准入与退出机制中陷入福利误区。而最终,行政法治逻辑中的公租房制度的正当性体系需要有效性、可接受性、形式法治等因素的共同支撑。
