摘要
《乡土中国》是费孝通的代表作,该书讲述了乡土社会这一问题。乡土中国的社会秩序是充满乡土气息的,是差序格局下的熟人社会,是礼治秩序下的无讼社会。随着时代的发展,乡土社会发生了变迁。送法下乡等法治宣传活动如火如荼地开展,它在带来一定积极作用的同时产生了诸多弊端。因此,必须构建以国家法治秩序为主导并与民间法相结合的多元化的乡土社会法律秩序。
From the Soil:the Foundations of Chinese Society is the typical work of Fei Xiaotong.It mainly tells about Chinese grass-roots society.I will analyze it from three aspects——local social order and changes,spreading law to the countryside and its influence,constructing rural social order of law.Rural China,with social order full of local flavor,emphasizing interdependence and rites,is a non-litigation society.With the development of the times,local society has undergone changes.Legal educational activities in countryside play a positive role in spite of some drawbacks.Therefore,I put forward the plan for building a wide range of legal order of local community.The legal order is led by the rule of national law and combined with civil law.This article is an overview of the above issues.
