摘要
民办高等教育的发展与其法制环境密切相关。作为当前民办教育最重要的一项制度安排,《民办教育促进法》无疑对民办高等教育的发展有着至关重要的影响。但由于其在立法过程当中的某些方面尚欠完善,使得民办高等教育发展受到制约。本文首先讨论了《民办教育促进法》中存在的法律缺失,诸如:产权归属不清晰、法人地位不明确、回报政策不到位,政府管理不规范等等。在此基础上,本文最后从法律政策层面对促进民办高等教育发展提出了建议。
The development of private higher education is closely related to its legal environment.As the most important constitution of contemporary private education,Private Education Promotion Law has with doubt the utmost significance to the development of private higher education.However,its deficiency during the legislative course restricts the development of private higher education.The paper firstly discusses the legal deficiencies in Private Education Promotion Law,such as the unclear management and ownership,the indefinite legal person status and the ineffective reciprocation policy as well as the nonstandard government management.Based on the above,the paper finally proposes suggestions of promoting the development of private higher education from the angle of legal policies.
