摘要
迄今为止一个公认的事实是,美国一方面具有最“古老”的自治实践、法治传统和当今世界上最庞大、最完备的法律制度体系,另一方面,美国又拥有当代西方乃至整个世界的最成熟的市场机制、最系统的现代企业制度和比较有效率的宏观调控组织。本文拟借助“人本主义经济学”的思想成果,探讨社会法律制度界面和经济机制界面之间各主要接口的设计原理,判别美国社会法律制度对于其经济机制的支持效率和相容程度。
This article discusses how representative democracy supports economic efficiency in America. It argues that the U.S. Law-governing system has the capacities of political power modification, auto efficiency stabilization and auto rectification. The system can effectively blend personal choice into social needs, enhance continuously the competitiveness and cooperativeness in the economic behavior of market, and supply the government in accordance with efficiency conditions.
