摘要
法院在刘海洋案的法律适用理由上,存在着重大的"合法性"瑕疵。这是法院在法律判决的合法性与妥当性间的无奈妥协,反映了刑事司法主流意识形态的尴尬。刑事司法的实质无非是:法律适用结果是否能够满足人们对刑法调整范围的心理预期。
There exist some important legitimacy defects in the judgment reasons of Liu hai-yang case. (It's) a weaken compromise between the conflicts of legitimacy and property. When we disclose the rational veil enveloping the criminal adjudication, we find that the nature of criminal adjudication is that whether or not the adjudication decision suits for the psychology expectations which people resort to the adjusting range of criminal law.
