摘要
行政权力特别是行政许可权的滥用是造成行政性垄断的直接原因,2003年颁布并将于今年正式实施的《行政许可法》,将从很大程度上削弱行政垄断行为。但是,行政性垄断所产生的复杂背景和历史原因决定了破除行政性垄断绝不是一蹴而就的,还需要各方面形成合力来共同打破,其中转变政府职能和健全法制是关键之所在。
Administrative power, especially the abuse of administrative permission power is the direct reason for the administrative monopoly. The Administrative Permission Law that is promulgated this year will greatly weaken the administrative monopoly undoubtedly. However, it is impossible to remove it right away because of the complicated background and historical reasons of forming it. We should make efforts to remove it thoroughly, and the key is to transfer the function of governments and strengthen the law system.
