摘要
刑罚是掌握政权的统治阶级用以惩罚犯罪的强制方法。为了论证其产生与存在的合理性 ,刑法学者们提出了同态复仇说、契约说、社会防卫说、惩罚需要说等众多学说 ,阐述了其各自学说的基本观点和基本理论。这些学说的相继提出 ,体现其所处的时代精神 ,反映其随着人类社会的发展、进步而逐渐迈向科学性。
Criminal penalty is a compulsory measure used by a ruling class with regime to punish crimes. In order to prove the rationality of its origin and existence, the scholars of criminal law advanced many theories such as theory of homeostasis vengeance, theory of contract, theory of social defense, and theory of punition need and respectively expounded the fundamental ideas and the basic theories of them. The theories being raised continuously demonstrate the spirits of the era when they are in. With the development of human society, the theories are progressed and become more and more scientific.
