摘要
新刑法对侵占罪的设立、弥补了财产犯罪立法的不足。但如何界定侵占罪与贪污罪、挪用公款罪等的区别？有必要将此罪的犯罪构成进一步明确。
The author of this article elaborates on the differences of the encroachment crimes stipulated in China's new“Criminal Law” from embezzlement offences and the offence of misappropriation of the public funds and carefully works out the essentials of the encroachment crimes.
