摘要
离婚扶养制度在处理离婚关系上一直发挥着重要的作用,但我国现行的离婚扶养制度对扶养条件要求过于严格,且相关法律规定笼统,缺乏可操作性,新《婚姻法解释(三)》更是使婚姻关系中房屋归属问题变得愈加尖锐,基于此有必要对离婚扶养制度进行完善,使其真正起到保护弱势一方权益的作用。
The system of spousal maintenance for divorce has been playing an important role in dealing with the divorce relationship. But the requirements of the current system of spousal maintenance for divorce are too stringent,and the relevant law provisions are too general. In addition,lacking of maneuverability is also a shortcoming of the system. Moreover,housing ownership problems in marriage relationship are becoming more acute because of the third judicial explanation of marriage law. So it is necessary to improve the system for protecting the weaker party's interests.
