摘要
理查德·A·波斯纳以其提出的法律经济分析被世人所熟知,他是自上世纪70年代以来最为优秀的法律经济学家中的一位,其将民众从相互自愿的交易中获得利益这一简单明了的经济理论与和经济效率有关的市场经济这两种原理,运用到法理学及法律制度的研究当中,为法律经济学的研究奠定了理论基础,从而对法学一般理论的发展作出了卓越的贡献,但其成就远超于此。回顾其本人近50年的学术历程,不难从其所有重要著作中看到他的法律思想经历了一个怎么的过程即从法律经济学转变为了实用主义法学。就其一生重要著作着重对这一转向做初步的探讨,同时提出:第一,波斯纳用实用主义哲学修正并包容其原有的法律经济学,继承与发展了霍姆斯以来的美国实用主义法学传统,并试图建构自己的法律理论;第二,这种思想的转变与发展背后,反映的是思想家改造法律和超越法律的雄心和努力等的观点。
Richard·A·Posner is well known by submitting the analysis of legal and economy,but his achievement was far more significant than this.Recalling his nearly fifty years of academic course,it is not hard to discover that there is a change in his legal thinking,which is a transformation from law of economy to pragmatism jurisprudence.It is discussed the change of his thinking based on his important works in the article.At the same time,I will put forward some viewpoints.Firstly,Posner used pragmatical philosophy to amend and include his original theory of law and economy,and he had inherited and developed the tradition of pragmatical law since Holmes in the United States.He also tried to construct his own legal theories;Secondly,behind the transformation and development of the idea,there is a reflection of the politician's ambitions and efforts.
