摘要
妥当划分和识别强制性规范的不同类型,是法院对强制性规范进行解释与适用的前提。传统的划分方法是在民法规范"二元论"思想指导下的"二分法"方法,但这种划分方法存在诸多缺陷,应当代之以民法规范"五分法"思想指导下的"七分法"方法,才能周延地揭示出强制性规范的全貌,并为法官妥当适用强制性规范奠定基础。
To properly identify the different types of mandatory norms in the civil law is the premise for the court to interpret and apply them.Therefore,the duality of the ideological norms and the'dichotomy'method should be abandoned due to their obvious flaws.The mandatory norms in the civil law should be divided into seven types under the guidance of new ideas that the civil norms are formed by five kinds of specification.Only by this way,can the complete picture of mandotory norms be sufficiently revealed,and the foundation for proper application of mandotory norms by the judge be laid.
