金融消费者保护机构的专门化

摘要 金融消费者保护机构的专门化,是指为了加强金融消费者保护而成立具有独立地位和权威的机构专门负责金融行业的消费者保护的立法和执法之趋向。它的理论基础与"双峰监管"理论、专业化分工理论、权力制衡原理及避免利益冲突的理论密切相关。次贷危机以来,强化金融消费者保护成为了各国金融监管改革的重要内容,国际范围内呈现出金融消费者保护机构专门化的趋势。我国应当先行完善立法,为建立金融消费者保护机构提供立法制度的保障,并赋予该机构预算独立、人事独立、运作独立的行政机构地位,执行规章制定、教育服务、投诉处理等职能。 The specialization of financial consumer protection authority is the legislative and enforcement trends of setting up an authority responsible for financial consumer protection. Its theoretical basis is closely related to Twin peaks theory、specialization and evolution theory、power balance principle and avoid conflicts of interest theory. Since the subprime mortgage crisis,enhanced the financial consumer protection become the important part of all countries' financial supervision reform,the specialization of financial consumer protection authority become a trend in the world. We should improve the legislation to provide a basis for setting up a financial consumer protection authority. The authority is an administrative agencies with budget、personnel and operational independence,and executing the functions of enacting regulations、education services、complaint handling and so on.
