摘要
在近代中国社会的房地交易领域,国家法的规定相对有限,民间的交易活动主要在以国家法为背景的地方性习惯基础上进行。各地的交易习惯主旨基本一致。
On the textual basis of contracts of real estate transactions and investigative reports on civil customs in modern China,this article studies the titles of the contracts in the period from late Qing Dy- nasty to the beginning of Republic of China,discussing their region- al discrepancies from the perspective of state legislation and of the relationship between mankind and lands.The article also argues that the understanding of customary laws in a vast territory in traditional China may be deepened from the perspective of regional studies.
