摘要
公众参与原则是环境保护法的基本原则,尤其是在环境日益恶化、环境保护工作更加艰巨的情况下,让公众参与进来,能够发挥公众的主动性和积极性,共同保护我们的环境。公众参与环境保护的工作已经体现在我国环境法的很多制度规定中。但是目前的实际参与状况并不是很理想。而对话性协商民主作为协商民主的一个模型,倡导公众和其他主体平等地参与到一个面对面的协商过程中,公众可以通过自由的发言和平等的对话阐述他们的观点,提出问题并得到有针对性的回答。这样,将对话性协商运用到公众参与环境保护中,公众就可以通过便利的渠道为其他主体提供一些环境信息,并且可以通过对话,把他们的智慧展现出来。政府部门能够通过与普通公众的对话和协商,扩大他们的信息范围,考虑得更加全面,从而得出更高质量的决策。
The principle of public participation is import in environmental protection,especially when the environment is deteriorating and the protecting work is harder.To invite the public to participate in the course,can inspire their initiative and enthusiasm to protect our environment altogether.The principle of public participating in environmental protection has been embodied in our country's legislations and prescriptions of institutions.But at the present,the condition of this isn't perfect.Discursive deliberation is one type of deliberative democracy.It advocates public and other subjects to take part in the process of face-to-face deliberation equally.Public can expound their viewpoints in free remarks and equal conversations,raise questions,and get pointed answers.Through applying discursive deliberation to public participating in environmental protection,the public are able to take full advantage of this chance to provide some relevant information.Besides,public can show the light spots of their wisdom.At the same time,the government branches can expand their range of information through these dialogues and deliberations,to consider all-around,finally make better decisions.
