论拒不支付劳动报酬罪中的“劳动报酬” 被引量:3

摘要 劳动报酬是拒不支付劳动报酬罪的核心范畴,对于拒不支付劳动报酬罪的认定具有重要意义。劳务关系和劳动关系在本质上没有区别,提供劳务者的报酬属于劳动报酬。加班费体现了劳动者的劳动力价值,是劳动报酬的重要组成部分。住房公积金和经济补偿金都属于劳动报酬的范围。社会保险具有社会福利性质,不应当属于劳动报酬。劳动者取得双倍工资不是基于劳动,双倍工资不具有劳动报酬的属性。非法劳动的收入不属于拒不支付劳动报酬罪的设立目的,不应将其纳入劳动报酬的范围。 Labor remuneration is the core category of the crime of refusing to pay labor remuneration,which has important significance to determine the crime.The relationship between different worker and the employer is no different,and the pay for those who provide services belongs to labor remuneration.Overtime wage which reflects laborer's labor value,is an important part of the labor remuneration.Housing provident fund and economic compensation for laborer are also labor remuneration.Social insurance has social welfare quality,so it should not belong to labor remuneration.Because double salaries are not based on labor,it does not have the attribute of labor remuneration.Illegal labor income does not conform to the purpose of the crime,so it should not be incorporated into the scope of labor remuneration.
