摘要
过错能力的认定标准成为了行为人是否应受到法律责难的关键问题。对行为人过错能力的认定,应当以行为人在行为之时的辨别能力为核心要素进行审查,当然辨别能力与人的年龄、精神状况等影响因素密切相关,应当将这些因素有机结合起来观察才能准确判定某一行为是否违反了一个"理性人"的注意义务,从而最终决定行为人有无侵权责任。
The identification of the fault capacity standards is a key issue of whether the perpetrator should be subject to legal censure.Identification of the fault of the actors ability,should be reviewed as the core elements of behavior in the ability to distinguish the behavior,of course,to identify the ability and age,mental condition and other influencing factors are closely related to these factors should combine observation can accurately determine whether an act in violation of a'reasonable person' duty of care,which ultimately determine the behavior of people with or without tort liability.
