摘要
刑民交叉案件是司法实践中一个复杂而又普遍的问题。我国现行立法对此缺乏系统而明确的规定,导致司法实践中此类案件的处理千差万别,也难以确保司法之公正。因此有必要进一步厘清刑民交叉案件中的有关法律问题,以期裨益于我国当前之司法实践。
Criminal and civil cross case is a complex and widespread problem in judicial practice.China's current legislation on such cases is not systematic and clear,which results in the various kinds of differences or disputes in handling such cases in judicial practice in China.It's difficult to ensure the fairness of judicature.Therefore it is necessary to further clarify the legal issues of criminal and civil cross case in order to benefit the current judicial practice of China.
