摘要
从档案文献汇编作品属于文学、艺术和科学领域,档案文献汇编作品具有独创性,档案文献汇编作品能够以有形形式复制三个方面阐述档案文献汇编作品具有著作权。分析了档案文献汇编作品的双重著作权特点,说明了档案文献汇编作品的合理使用范围,得出档案文献汇编作品应受双法制约的结论。
Works made of archives and documents compilation usually belong to the domains of literature,arts and science,have the unique creation and can be copied by the form of apparent shape.These three aspects explain the fact that works of archives and documents compilation have the copyright.Then the paper analyzes the characteristics of double copyrights about works of archives and documents compilation,expounds their sensible range of uses,and concludes that theses works are restricted by double laws.
