摘要
行政调查是政府作出行政行为或决策的核心活动,是行政行为形成的基础。基于不同的行政法传统,各国家就行政调查的理论与制度存在一定差异。英国的行政调查专注于事先的听证和异议申诉;美国的行政调查是行政机关履行法定职责的一种行政行为;法国的行政调查主要运用在不动产的公用征收中。虽然三国具体行政调查制度不同但在相同的法治理念下都运行了相同的行政调查规则:正当程序、调查报告和司法救济。
Administrative investigation action is the key process when government makes decision.Different countries have different administrative investigation system due to the various administrative law traditions.British administrative investigation system stress on hearing and appeal.American administrative investigation is just a kind of administrative action type.French administrative investigation mainly utilizes in public expropriation.Though the tree countries have the different administrative investigation system,they applied three same regulations in it.Those regulations are due process and investigation reports and judicial remedy.
